Terms of Service.

These Terms govern use of Billboard Badger, operated by Dale Mooney, a sole trader based in the United Kingdom (the Operator). Creating an account or using the service accepts them. Billboard Badger is built in phases, in the order on the roadmap. A clause about a part that is not live yet applies from the day that part goes live.

Who can use it

Account holders must be 18 or over and able to enter a contract. An account opened for a business confirms authority to accept these Terms for it. One user per account.

What Billboard Badger does

Billboard Badger reads the sites of products the account holder adds, drafts marketing posts and artwork, keeps a schedule, and publishes only to accounts the account holder connected, only what was approved or booked under the sending rules shown in the product. It is provided as is and as available, and features may change with reasonable notice where the change is within the Operator's control.

Your responsibility for what is posted

The account holder is responsible for everything posted on their connected accounts, including anything Autopilot sends that they did not stop in its review window, and for keeping to each platform's own rules. A product may only be added if it is the account holder's own, or marketed with its owner's permission.

Platforms

Each channel depends on a platform's API. Platforms can change, restrict or withdraw their APIs at any time, and a channel may stop working without notice as a result. The Operator will say so plainly and will not charge for a channel that cannot be offered.

Acceptable use

The Acceptable Use Policy is part of these Terms. The Operator may suspend an account that breaks it, pausing all sending.

Your content

The account holder owns what they put in and what is made for them, and grants the Operator the permission needed to host, process and publish it to run the service. Personal data is handled as the Privacy Notice and DPA set out.

Price, trial and cancelling

Billboard Badger is sold as the Solo, Practice and Studio plans, monthly or yearly, at the prices on the price page. The first 30 day period is a trial: nothing is charged until it ends, and cancelling inside it takes nothing. A plan renews until cancelled and then runs to the end of the period paid for. Payments are not refunded for part periods, except where the law requires. Without a live plan nothing is made or sent, and everything stays readable, downloadable and deletable. Reasonable notice is given before a price changes.

Warranties and liability

To the extent the law allows, implied warranties are excluded. Nothing limits liability for death or personal injury caused by negligence, or for fraud. Otherwise the Operator is not liable for indirect or consequential loss, lost profits or lost data, and total liability in any twelve months is limited to the greater of the fees paid in that time or £50. A consumer's statutory rights are unaffected.

Suspension and closing

The account holder may delete their account at any time from the account page. The Operator may suspend or close an account for breach of these Terms, or where needed for legal, security or safety reasons, with notice where practical.

Changes and law

These Terms may be updated, with reasonable notice of a significant change. They are governed by the laws of England and Wales, whose courts have jurisdiction. Questions go to legal@billboardbadger.com.
